These Terms of Use ("Terms") constitute a legally binding agreement between you and SkrewAI LLC ("Company," "we," "us," or "our") concerning your use of the SkrewAI Camera mobile application (the "App"). By accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

3. Description of Service

SkrewAI Camera is a mobile application that provides video authentication services through proprietary algorithms that verify human interaction during video recording. The App:

• Captures and authenticates video content in real-time
• Provides cryptographic proof of human recording
• Helps protect against deepfake and AI-generated content
• Is provided free of charge for personal and professional use

4. Eligibility

You must be at least 16 years old to use the App. By using the App, you represent and warrant that:

• You are at least 16 years of age
• You have the legal capacity to enter into these Terms
• You are not barred from using the App under any applicable laws
• If you are under 18, you have parental or guardian consent

5. User Account

5.1 Account Creation

To access certain features of the App, you may need to create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use
• Accept responsibility for all activities under your account

5.2 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent or illegal activities.

6. License Grant

6.1 License to Use the App

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal mobile device solely for your personal or internal business purposes.

6.2 License Restrictions

You agree not to:

• Copy, modify, or create derivative works of the App
• Reverse engineer, disassemble, or decompile the App
• Sell, rent, lease, or sublicense the App
• Use the App for any illegal or unauthorized purpose
• Violate any applicable laws or regulations
• Circumvent or disable any security features
• Use the App to create false or misleading content

7. User Content

7.1 Your Content

You retain all rights to the videos and content you create using the App ("User Content"). By using the App, you grant us a limited license to process your content solely for the purpose of providing authentication services.

7.2 Content Responsibilities

You are solely responsible for your User Content and agree not to create or share content that:

• Violates any laws or regulations
• Infringes on intellectual property rights
• Contains harmful, offensive, or inappropriate material
• Violates the privacy or rights of others
• Contains malware or harmful code
• Impersonates another person or entity

8. Intellectual Property Rights

8.1 Our Property

The App and all its content, features, and functionality (including but not limited to software, text, displays, images, graphics, logos, and button icons) are owned by SkrewAI LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

8.2 Trademarks

SkrewAI, the SkrewAI logo, and all related names, logos, product and service names, designs, and slogans are trademarks of SkrewAI LLC. You may not use such marks without our prior written permission.

9. Privacy and Data Protection

Your use of the App is also governed by our Privacy Policy, which is incorporated by reference into these Terms. We are committed to protecting your privacy and complying with applicable data protection laws including GDPR and CCPA.

10. Disclaimers

10.1 "As Is" Basis

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

10.2 No Guarantee

While we strive to provide accurate authentication services, we do not guarantee that:

• The App will be uninterrupted or error-free
• The authentication will be 100% accurate in all cases
• The App will meet all your requirements
• Any defects will be corrected

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SkrewAI LLC BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE APP.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT OF ONE HUNDRED EUROS (€100) OR THE AMOUNT YOU PAID US, IF ANY, IN THE PAST SIX MONTHS FOR THE SERVICES GIVING RISE TO THE CLAIM.

12. Indemnification

You agree to defend, indemnify, and hold harmless SkrewAI LLC and its officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the App.

13. Governing Law and Jurisdiction

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Serbia, without regard to its conflict of law provisions.

13.2 Jurisdiction

Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts in Belgrade, Serbia.

13.3 EU Users

If you are a consumer residing in the European Union, you will benefit from any mandatory provisions of the law of the country in which you are resident.

14. Dispute Resolution

14.1 Informal Resolution

Before filing a claim, we encourage you to contact us at info@skrew.ai to attempt to resolve any dispute informally.

14.2 Arbitration

If we cannot resolve a dispute informally, any dispute will be resolved by binding arbitration in accordance with the rules of the Serbian Chamber of Commerce, except to the extent you have violated or threatened to violate our intellectual property rights.

15. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by:

• Updating the "Effective Date" at the top of these Terms
• Sending an email to registered users
• Displaying a notice in the App

Your continued use of the App after such modifications constitutes your acceptance of the updated Terms.

16. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will cease immediately.

17. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

18. Waiver

No waiver by the Company of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition.

19. Export Compliance

You may not use or export the App in violation of Serbian export laws and regulations or any other applicable export laws and regulations.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SkrewAI LLC regarding the use of the App and supersede all prior agreements and understandings.

If you are located in the European Union:

• You have the right to withdraw from these Terms within 14 days without giving any reason
• You may have additional rights under the Digital Services Act and Digital Markets Act
• Nothing in these Terms affects your statutory rights as a consumer
• For disputes, you may use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr

23. Special Provisions for US Users

23.1 DMCA Compliance

We respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA). To report copyright infringement, contact us at info@skrew.ai with the subject line "DMCA Notice".

23.2 California Users

If you are a California resident, you have specific rights under the California Consumer Privacy Act (CCPA) as outlined in our Privacy Policy.

23.3 State-Specific Provisions

Some states do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, so the above limitations may not apply to you.

25. Force Majeure

We shall not be liable for any failure or delay in performance under these Terms which is due to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
